Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs the use of Review Growth's platform and SMS messaging service. By using Review Growth, you (the "Sender") agree to comply with this AUP. Violations may result in immediate suspension or termination of your account, and Review Growth may report violations to mobile carriers, The Campaign Registry (TCR), and law enforcement where appropriate.

1. Prior Express Written Consent Required

You may only use Review Growth to send SMS messages to Recipients who have provided you with prior express written consent to receive SMS messages from your business, including post-purchase review request messages. This consent must be:

• Explicit. Recipients must clearly agree to receive SMS messages from your business. Consent cannot be bundled, buried in fine print, or presumed from a prior transaction alone.
• Documented. You must retain records of how, when, and where each Recipient provided consent (e.g., signed intake form, point-of-sale opt-in, online form submission, CRM log).
• Producible on request. You must be able to produce consent records to Review Growth within 5 business days of a request, and within 24 hours for regulatory or carrier inquiries.
• In compliance with the TCPA. Consent must meet the requirements of the Telephone Consumer Protection Act (47 U.S.C. § 227), FCC regulations, CTIA Messaging Principles and Best Practices, and all applicable state laws.

2. Consent Attestation

At account onboarding and before each contact list upload, you must affirmatively certify — via a mandatory checkbox — that every contact on the list has provided prior express written consent as described in Section 1. Checking this box constitutes a binding legal representation to Review Growth. Misrepresentation of consent status may result in immediate account termination and is grounds for civil liability under the TCPA, which provides for statutory damages of up to $1,500 per violation.

3. Opt-Out Honor

Recipients may opt out of SMS messages at any time by replying STOP, CANCEL, UNSUBSCRIBE, END, or QUIT to any message. Review Growth automatically processes opt-outs and adds the opting-out phone number to a platform-wide suppression list within seconds.

Once a phone number is on the suppression list, Review Growth will block all further SMS messages to that number from any business customer. You may not attempt to circumvent the suppression list by uploading the same number under a different contact name, from a different device, or through any other means.

You must also honor opt-out requests received outside of Review Growth (e.g., verbal requests, emails, written notices) by removing those Recipients from your contact lists before uploading.

4. Prohibited Content

You may not use Review Growth to send SMS messages containing, promoting, or linking to:

• SHAFT content — Sex, Hate, Alcohol, Firearms, or Tobacco (including vaping, e-cigarettes, and cannabis products)
• Gambling, lotteries, sweepstakes, or contests with entry fees
• Payday loans, high-interest consumer lending, or debt-collection content
• Cryptocurrency trading, NFTs, or investment solicitations
• Adult or sexually explicit content
• Hate speech, harassment, or content that discriminates on the basis of race, religion, national origin, gender, sexual orientation, or disability
• Deceptive, fraudulent, phishing, or scam content
• Misleading claims about your business, products, services, or review authenticity
• Content that impersonates another person, business, or government entity
• Any content that violates federal, state, or local law

5. Message Content Requirements

All SMS messages sent through Review Growth must:

• Clearly identify the sending business by name
• Be relevant to a recent transaction or ongoing relationship between the Sender and the Recipient
• Include "Reply STOP to unsubscribe" on initial messages
• Not contain URL shorteners other than those provided or approved by Review Growth
• Not include embedded phone numbers unless clearly relevant to the Recipient's prior transaction
• Comply with CTIA Messaging Principles and Best Practices

6. Prohibited Uses

You may not use Review Growth to:

• Send messages to Recipients who have not provided prior express written consent
• Send messages to phone numbers purchased, rented, or scraped from third-party sources
• Send messages to Recipients outside the United States or Canada without explicit approval from Review Growth
• Send messages at an abusive frequency (more than 3 review-request messages per Recipient per 14-day period)
• Send messages between 9:00 PM and 8:00 AM in the Recipient's local time zone
• Engage in snowshoe spamming or other sender-rotation tactics designed to evade carrier filtering
• Test the platform by sending messages to numbers you do not own or control
• Collect, compile, or resell Recipient phone numbers or contact information

7. Enforcement

Review Growth actively monitors platform activity for compliance with this AUP. We may suspend or terminate your account, with or without notice, if we determine in our sole discretion that you have violated this AUP. For severe violations — including sending to non-consented numbers, prohibited content, or circumventing opt-outs — termination is immediate and without refund.

Review Growth may cooperate with mobile carriers, The Campaign Registry (TCR), the Federal Trade Commission (FTC), the Federal Communications Commission (FCC), state attorneys general, and law enforcement in investigating AUP violations and may disclose your account information as required by law or in response to valid legal process.

8. Indemnification

You agree to indemnify, defend, and hold harmless Review Growth, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of this AUP, including any claims brought by Recipients under the TCPA or other applicable laws.

9. Changes to This Policy

Review Growth may update this AUP from time to time. Material changes will be announced via email or in-app notification at least 7 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated AUP.
